Terms of Service

1. Acceptance of Terms

The Service is owned and operated by Postpoint LLC ("Postpoint," "we," "us," or "our"). These Terms govern your access to and use of the Service, including all content, features, and functionalities offered on or through Postpoint, including the native in-app visual verification map (the "Atlas") and enterprise integration protocols ("Postpoint API"). Postpoint is a professional verification utility and does not support peer-to-peer social messaging or external social networking feeds.

2. User Eligibility and Device Security

• 2.1. Eligibility and Age Classifications: You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant to us that you meet this requirement.
• 2.2. Platform-Specific Store Ratings: Users must acknowledge and comply with the respective marketplace age classifications required for application download:
  • Google Play Store: Rated 13+ (Teens).
  • Apple App Store: Rated 17+ (Adults Only). This platform-enforced 17+ tier is strictly required due to the real-time, unmoderated distribution of media captures published to the public Atlas verification map feed.

  If you are under the mandatory age requirement specified by your respective device platform, you are structurally prohibited from downloading, accessing, or utilizing the Service.

• 2.3. Device Security: You are solely responsible for securing your physical device and controlling all content submissions, API key credentials, and data transfers dispatched from your installation of the Service.

3. User Content and License Grant

• 3.1. Content Ownership: You retain all ownership rights to the content (including photos, videos, and associated metadata) you submit, post, or display on or through the Service ("User Content").
• 3.2. License to Postpoint: By posting User Content, you grant Postpoint a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, format, display, transmit, and route User Content in connection with the Service—including displaying ephemeral captures on the internal Atlas map during active decay windows or delivering Data Receipts straight into designated enterprise CRM, ERP, or Field Service Management (FSM) software.
• 3.3. The Data Receipt / Verification: You acknowledge that the Service's core value is based on the Postpoint Protocol, Tamper-Evident Signatures, and non-modifiable metadata (the "Data Receipt"). You grant Postpoint the perpetual, irrevocable right to retain, use, and process this Data Receipt for verification, auditability, anti-fraud enforcement, and platform security, even if the visual User Content itself is later deleted or expires.

4. Prohibited Uses

You agree not to use the Service for any purpose that is prohibited by these Terms, technical specifications, or the platform Camera Policy. Prohibited uses include:

• 4.1. Violating any applicable law or regulation.
• 4.2. Infringing upon the rights of others, including intellectual property rights.
• 4.3. Distributing viruses or other harmful computer code.
• 4.4. Attempting to gain unauthorized access to Postpoint's backend systems or database architecture.
• 4.5. Attempting to bypass native camera controls, inject virtual camera streams, spoof GPS telemetry, alter device timestamps, or engage in any activity that undermines the cryptographic integrity of the Data Receipt or Postpoint Protocol.
• 4.6. Recording video or audio through the Service, you are solely responsible for providing notice and obtaining all legally required consents from individuals captured in such media, in full compliance with applicable state, federal, and international wiretapping and privacy laws.

5. Intellectual Property Rights

Postpoint's name, logo, Postpoint Protocol, Data Receipt specifications, and all related names, designs, and slogans are trademarks of Postpoint LLC or its affiliates or licensors. You must not use such marks without the prior written permission of Postpoint.

6. Termination and Access Restriction

We may terminate, block, rate-limit, or suspend your device or API access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, without limitation, a breach of these Terms, unauthorized API usage, or attempts to tamper with hardware verification signatures.

7. Disclaimers and Limitation of Liability

• 7.1. No Warranty: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Postpoint makes no warranties, expressed or implied, regarding system uptime, uninterrupted API operations, or absolute immunity against hardware-level spoofing.
• 7.2. Limitation of Liability: In no event shall Postpoint, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any third-party reliance on Data Receipts or Ground Truth Verification logs; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

8. Copyright Policy & DMCA Safe Harbor Notice

Postpoint respects the intellectual property rights of others and expects its users to do the same. Pursuant to 17 U.S.C. § 512(c) (the Digital Millennium Copyright Act of 1998), Postpoint provides a safe harbor mechanism for copyright owners to report alleged copyright infringements occurring on public surfaces of the Service, including the Postpoint Atlas map.

• 8.1. Designated DMCA Agent: Notifications of claimed copyright infringement must be submitted in writing to Postpoint's Designated Copyright Agent:

• 8.2. Takedown Notification Requirements: To be effective under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must include the following:
  • 8.2.1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • 8.2.2. Identification of the copyrighted work claimed to have been infringed (e.g., blueprints, proprietary job site documents, branded media).
  • 8.2.3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including specific Postpoint capture IDs, geographic coordinates, or direct links on the Atlas map.
  • 8.2.4. Information reasonably sufficient to permit Postpoint to contact the complaining party (address, telephone number, and email address).
  • 8.2.5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • 8.2.6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• 8.3. Expedited Takedown Protocol & Immunity: Upon receipt of a valid, compliant DMCA notice, Postpoint will act expeditiously to remove or disable access to the visual media asset on the public Atlas map and public-facing indexes within 24 hours. In accordance with federal law, Postpoint's strict compliance with this takedown procedure insulates and completely relieves Postpoint from monetary damages or liability arising from third-party copyright claims.
• 8.4. Repeat Infringer Policy: Postpoint reserves the right, in its sole discretion, to terminate access, forfeit remaining capture credits, and permanently ban the device ID or API access of any user who is determined to be a repeat infringer of third-party intellectual property rights.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 14 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
